			<content:encoded><![CDATA[<p>If contending with a certain PS3 developer called Geohot wasn&#8217;t enough for <a href="http://www.product-reviews.net/tag/sony">Sony</a>, the electronics giant is once again back in the headlines for all the wrong reasons. This time we&#8217;re hearing that an official class action lawsuit has targeted Sony, demanding for the answers as to why they moved the &#8216;Other OS&#8217; option from the Sony PS3.</p>
<p>You can view the <a href="http://ps3movies.ign.com/ps3/document/article/115/1157475/IGN_PS3_Filed_Amended_Complaint.pdf">complaint in full here</a>, as <a href="http://www.vg247.com/2011/03/24/class-action-suit-over-other-os-removal-claims-no-justifiable-security-reason-scea-did-it-to-save-money/">reported</a> from VG247 and it&#8217;s quite a read we have to say. Basically the issue here is that Sony removed the Other OS option in their <a href="http://www.product-reviews.net/2010/03/29/sony-ps3-update-3-21-linux-support-removed/">PS3 Firmware Update 3.21</a>, an option which allowed users to run things like Linux and other legal custom made programs.</p>
<p>However, Sony&#8217;s reason for removing this feature was &#8216;security&#8217; based, while the class action lawsuit states that Sony did this to save money. Obviously if Sony are found guilty as a result of this case, it means that it&#8217;s essentially a case of false advertising and it could lead to big trouble for the company, as they were advertising features which were ultimately removed for no good reason.</p>
<p>What are your thoughts on this? What are your predictions for the outcome? Do you think Sony has an argument this time on the Other OS debate, or is it time for them to admit that removing that feature was a mistake last year. </p>

			<content:encoded><![CDATA[<p>Just a day after Microsoft filed another lawsuit against <a href="http://www.product-reviews.net/2010/11/05/att-motorola-droid-x-2-an-iphone-4-alternative/">Motorola</a> for alleged infringement of nine patents, Motorola hit back by alleging that Microsoft had infringed sixteen of its patents.<span id="more-113545"></span></p>
<p>Dan Nystedt of <a href="http://www.computerworld.com/s/article/9196079/Motorola_retaliates_with_lawsuit_against_Microsoft?taxonomyId=17">ComputerWorld</a> is reporting that Motorola are accusing <a href="http://www.product-reviews.net/2010/11/10/microsoft-kinect-hacked-open-source-driver-now-available/">Microsoft</a> of infringing 16 of its patents, which include mobile and server software, Xbox products, and PC. It was only last month when Microsoft were first to launch a lawsuit against Motorola for nine patents in handsets which use the Android operating system.</p>
<p>Then on Tuesday they followed that up with another suit for licensing terms for technology the company uses in its Xbox games consoles.  Motorola counter sued by filing the current lawsuit via the U.S. District Courts for the Southern District of Florida and the Western District of Wisconsin. This covers patents that include e-mail technology found in Messenger and outlook, and Windows Live instant messaging software.</p>
<p>Some are saying that a lot of the lawsuit activity is aimed at Android due to the fact it has grown so quickly, with Motorola seeing its smartphone sales rise from 2.7 million in the second quarter, to 3.8 million in the third. </p>

This practice of illegal downloading is frowned upon by not only record companies, but by the artist as well. So when news like Jammie Thomas-Rasset getting fined $1.5 million for illegal downloads, they feel that this shows a good message.<span id="more-113150"></span></p>
<p>That fine was for 24 songs, so that works out that she paid $62,500 per song – not so free after all. I wonder if she regrets taking the lawsuit imposed by Recording Industry Association of America to a jury trial? This is not the first lawsuit of its kind, but not sure if we will see anymore.</p>
<p>Thomas-Rasset should consider herself lucky; she could have been fined up to $150,000 per track, which she downloaded from Kazaa. As expected, she will be appealing the fine, but do you think that she stands a chance of winning that appeal?</p>
<p>The Recording Industry Association of America will not continue to hunt down every file sharer downloader, but they have shown their teeth. Do you agree with this fine? There is nothing like cooking at home and knowing how your food was made, but then a tasty Burger King or McDonald&#8217;s is hard to beat.<span id="more-98123"></span></p>
<p>These concerns became reality for one customer at Burger King, a Washington state police officer is claiming that a Burger King employee spat on his burger, and is even taking legal action to the sum of $75,000.</p>
<p>You can read the full story <a href="http://www.digitaljournal.com/article/290640">on Digital Journal</a>, which states that the Sheriff’s Deputy was suspicious after ordering at 2am in a marked sheriff&#8217;s car. After pulling over he said he found a “big gob of spit” in the burger.</p>
<p>After DNA samples were taken they showed a match to one of the workers, read more about the sentencing in the above link and how Deputy Bylsma feels Burger King is “negligent” for the supervision, training, and selection of employees.</p>
