Purchased New Zune Flash Player: days before official release

While many of you have been waiting for the official release of the new Zune Flash Player, someone has apparently managed to purchase a new Zune player days before its release in an Office Depot in St. Louis.
According to Gizmodo, Ed (a Zunerama community member) has got his hands on one but unlucky for him it does not work without an impending firmware release.
Could you believe that Ed then went on to phone Microsoft and moan it was not working, but then you can understand as he was sold a device that does not work.

Microsoft told Ed “be patient, the firmware will be released on Tuesday”.
What would you of done in the same situation?

The problem is that
1. He was sold the device against Microsoft’s wishes (by a retailer)
2. He knew he was getting an advanced product and it probably wouldn’t work since the new software hasn’t been released yet. (Since he’s a member of a Zune fansite)
I can’t say this was totally unexpected. IU’d have been annoyed, but it would’ve been understandable that the things didn’t work.
Wow, I work at Office Depot, they put in the registers a warning if you sell you may be terminated. PLUS you need a managers keys to override ALONG with an ID. Corporate tracks it as they “May lose microsoft as a vendor” Yeah right.
